Welcome to OwnTheOrder

These Terms of Use explain the rules for using the OwnTheOrder ordering system and provide important information regarding orders placed at participating restaurants.

OwnTheOrder is provided by 4Unit Systems Integration GmbH (hereinafter "4Unit") and offers a technical ordering system through which users can place orders at restaurants.

How does OwnTheOrder work?

What is OwnTheOrder?

OwnTheOrder is a technical ordering system provided by 4Unit Systems Integration GmbH, through which users can place orders at participating restaurants. Access is provided via a website or app.

OwnTheOrder exclusively provides the technical infrastructure.

Who is your contractual partner?

The purchase agreement for food and beverages is concluded exclusively between you and the respective restaurant. 4Unit does not become a contracting party to the purchase agreement.

  • 4Unit provides the ordering system and technical order processing
  • The restaurant is responsible for preparation, quality, prices, and delivery or pickup
  • Payment processing is handled by an external payment service provider as part of the ordering process

Payment & Payment Processing

Payment is made during the ordering process through the available payment service provider. 4Unit does not process complete payment data.

Service Fee

A service fee of €0.29 per order may be charged for use of the ordering system. The service fee is charged independently of the restaurant and is separately itemized.

Requirements for Use

What do you need?

To use OwnTheOrder, you need:

  • an internet-enabled device (e.g., computer, smartphone, or tablet),
  • a valid email address,
  • a payment method available at the respective restaurant (e.g., credit card, PayPal, Apple Pay, Google Pay, or cash payment if offered).

Who may place orders?

Use of the ordering system is permitted only for persons of legal age (18 years or older).

Orders are exclusively for delivery or pickup of food for immediate consumption and do not establish any special, catering, or business relationships, regardless of whether the orderer is a private individual or a company.

For orders containing alcoholic beverages, an age verification will be conducted upon handover by the respective restaurant or delivery service.

User Account

Use of OwnTheOrder is generally possible without registration.

A user account is required if you wish to:

  • pay with cash, or
  • use certain convenience features

With a user account, you can:

  • pay with cash (to prevent abuse and prank orders)
  • view the status of your order
  • save favorite dishes
  • store delivery addresses
  • view your order history

Registration of a user account is free of charge.

How Ordering Works

Ordering Process

The ordering process follows these steps:

  1. Select Restaurant: Choose a participating restaurant in your area.
  2. Select Food: Compile your desired order.
  3. Delivery or Pickup: Choose between delivery or pickup, if offered by the restaurant.
  4. Payment: Select one of the available payment methods.
  5. Order Confirmation: You will receive an order confirmation by email.

Acceptance of Order by Restaurant

Your order constitutes an offer to the respective restaurant. The purchase agreement is concluded only when the restaurant accepts the order.

The restaurant may reject an order particularly if:

  • the desired food items are not available,
  • the restaurant is temporarily at capacity,
  • the specified delivery address is outside the delivery area,
  • technical or organizational reasons exist.

Modifications or Cancellation

Modification or cancellation of an order is only possible as long as the restaurant has not yet accepted the order.

After acceptance of the order and particularly after preparation has begun, cancellation is generally excluded, unless statutory defect rights exist.

Prices and Fees

The following costs may apply to an order:

  • Food and Beverages: Prices are set exclusively by the respective restaurant.
  • Service Fee: A service fee of €0.29 per order may be charged by 4Unit Systems Integration GmbH for use of the ordering system.
  • Delivery Costs: Any delivery costs are set by the restaurant and separately itemized.
  • Value Added Tax: All stated prices include statutory value added tax.

Minimum Order Value

Any minimum order value will be displayed to you before completing the order and is set by the respective restaurant.

Payment

Payment Options

Online Payment

When using an online payment method, payment is processed during the ordering process as follows:

  • Authorization: Upon completing the order, the corresponding amount is first authorized (reserved).
  • Acceptance by Restaurant: If the restaurant accepts the order, the amount is charged accordingly.
  • Rejection by Restaurant: If the restaurant rejects the order, the authorization is released.

Note: Release of an authorization may take up to several business days depending on the payment service provider or bank. 4Unit has no influence over this.

Cash Payment

Cash payment is only possible when using a valid user account. Payment is made directly to the restaurant upon pickup or delivery. The invoice amount should be prepared as exact as possible.

The restriction on cash payment serves to prevent abuse and prank orders.

Delivery and Pickup

Delivery Area

Each restaurant determines its individual delivery area. Whether delivery to your address is possible is automatically verified during the ordering process, particularly based on:

  • your postal code,
  • distance to the restaurant,
  • geographic or organizational delivery boundaries of the restaurant.

There is no entitlement to delivery if the address is outside the delivery area.

Delivery Times

Delivery times displayed during the ordering process are non-binding estimates and may vary, particularly due to:

  • current order volume
  • traffic or weather conditions
  • staffing or capacity situations at the restaurant

No guarantee is provided for specific delivery times.

For Delivery

When selecting delivery, you are obligated to:

  • provide a complete and correct delivery address
  • be reachable during the specified time window

If delivery is not possible due to unavailability, the restaurant may cancel the order. Refund is excluded in this case if the food has already been prepared.

Notes for Pickup

When selecting pickup, the following applies:

  • You will be notified once your order is ready for pickup
  • please have your order number ready (digital or printed)
  • the order must be picked up promptly

If pickup does not occur in a timely manner, the restaurant may discard the order. No entitlement to refund exists in this case.

Right of Withdrawal

Do you have a right of withdrawal?

No right of withdrawal exists, as these are goods that are perishable, intended for immediate consumption, or not suitable for return due to health protection or hygiene reasons, particularly prepared meals and food items.

Your Rights in Case of Problems

Even without a right of withdrawal, statutory defect rights remain unaffected. In case of defective food (e.g., incorrect or incomplete delivery), these claims exist against the respective restaurant.

In case of legitimate defects in delivered food, the following claims may exist against the respective restaurant – within the framework of statutory provisions:

  • Replacement delivery, if possible and reasonable
  • Price reduction (partial refund) for partial or minor defects
  • Refund of the purchase price if replacement delivery is not possible or a substantial defect exists

Important: Defects should be reported immediately, but no later than 2 hours after receipt of the order, to enable timely inspection and remedy.

Complaints

What to do in case of problems?

If you have questions or problems related to your order, please contact the respective restaurant directly. The restaurant is your contractual partner and responsible for the order, delivery, and processing.

OwnTheOrder exclusively provides the technical ordering capability and is not involved in processing or handling complaints.

What is the restaurant liable for?

The restaurant is solely responsible for all services related to the order, particularly for:

  • the quality, freshness, and proper preparation of food
  • the completeness and accuracy of the order
  • the correct labeling of allergens, additives, and ingredients
  • compliance with food safety and hygiene regulations
  • delivery, pickup, and customer communication

What is 4Unit liable for?

4Unit exclusively provides the technical ordering system. No liability exists for content or services of the restaurant.

In particular, 4Unit is not liable for:

  • quality, condition, or safety of food
  • delivery times or delivery failures
  • errors in preparation or compilation
  • allergic reactions or health impairments
  • food safety violations by the restaurant

Important: 4Unit's liability for damages arising from injury to life, body, or health, as well as in cases of intent or gross negligence, remains unaffected.

Data Protection

What data do we collect?

  • Contact Information: Name, email address, telephone number
  • Delivery Address: for delivery of the order
  • Order Information: for display and processing of the order
  • Payment Data: Payment processing is handled by the external payment service provider Stripe. 4Unit does not receive complete payment data (e.g., credit card numbers).
  • Location Data: only if you expressly consent (e.g., for address determination)

What do we use your data for?

  • To process your order, including technical transmission to the restaurant
  • For communication related to your order (e.g., order confirmation, inquiries)
  • To ensure technical operation and error analysis of our ordering system
  • For marketing purposes, exclusively with your prior consent

Disclosure to Third Parties

Your personal data will only be disclosed to the extent necessary to process your order:

  • To the respective restaurant: Name, contact information, delivery address, and order information (for preparation and delivery of the order)
  • To payment service provider Stripe: Payment information for the purpose of payment processing (4Unit does not receive complete payment data)

No further disclosure occurs, unless we are legally obligated to do so.

Your Rights

Within the framework of statutory provisions, you have the right to:

  • Access to your personal data stored with us
  • Rectification of incorrect or incomplete data
  • Erasure of your personal data
  • Restriction of processing
  • Data portability, if statutory requirements are met
  • Object to the processing of your data

Usage Rules

Use of the ordering system may only occur within the intended scope.

Particularly prohibited are:

  • the use of automated systems or scripts (e.g., bots) for data retrieval or ordering
  • abuse of discounts, vouchers, or promotions
  • prank or test orders without intent to order
  • false or misleading information when ordering
  • creation of multiple user accounts to gain advantages
  • attacks on the technical security or functionality of the system

Consequences of Violations

In case of violations of these usage rules, we reserve the right to take appropriate measures within the framework of legal possibilities.

These may include in particular:

  • blocking or restriction of the user account
  • cancellation of obviously abusive orders
  • assertion of damage claims
  • notification of competent authorities in case of criminally relevant behavior

Changes to These Terms

We reserve the right to modify these Terms of Use if there is a legitimate reason to do so, particularly in case of:

  • changes in statutory requirements
  • introduction of new or adjusted features
  • technical or security-related adjustments

We will inform you of substantial changes at least 30 days before they take effect by email.

If you do not object to the changes within this period, the modified terms shall be deemed accepted.

We will expressly inform you in the change notification of your right to object and the possibility to terminate use.

Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Place of Jurisdiction

For merchants, legal entities under public law, or special funds under public law, the place of jurisdiction is the registered office of 4Unit Systems Integration GmbH. For consumers, statutory place of jurisdiction provisions apply.

Severability Clause

Should any provision of these Terms of Use be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
